Data Security

The data controller must plan and carry out data processing operations in a way that ensures the protection of the privacy of data subjects.

The data controller, as well as any data processors within its scope of activities, are obliged to ensure the security of data and to take the necessary technical and organizational measures and establish procedural rules necessary to enforce the provisions of the Information Act and other data and confidentiality protection regulations.

Appropriate measures must be taken to protect data, particularly against unauthorized access, alteration, transmission, disclosure, deletion, or destruction, as well as against accidental loss or alteration of availability due to changes in the applied technology.

In order to protect electronically managed datasets in different records, appropriate technical solutions must be provided to prevent direct correlation of the data stored in the records - except if permitted by law - and their association with the data subjects.

During automated processing of personal data, the data controller and the data processor must take further measures to prevent unauthorized data input; prevent unauthorized use of automated data processing systems by individuals with data transmission devices; verify and determine which organizations the personal data have been or can be forwarded to using data transmission devices; verify and determine which personal data were, when, and by whom entered into the automated data processing systems; restore installed systems in case of malfunctions; and report errors occurring during automated processing.

When determining and implementing measures to ensure data security, the data controller and the data processor must take into account the current level of technology. Among several possible data processing solutions, the one that provides a higher level of protection of personal data must be chosen, except if it would pose disproportionate difficulty to the data controller.

Right to Data Portability

In accordance with Article 20 of the GDPR, the data subject is entitled to receive their data provided to the data controller:

in a structured, commonly used, machine-readable format
has the right to transmit those data to another controller
may request the direct transfer of data to another controller – if technically feasible
except: processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller

This is a new right that strengthens control over one's own data, which can be exercised when data processing is automated, and the data controller processes the data based on the consent of the data subject or on a contractual basis.

Recourse

The user can object to the processing of their personal data if:
a) the processing or transmission of personal data is necessary for the performance of a legal obligation incumbent on the Service Provider or for the exercise of legitimate interests pursued by the Service Provider, the data recipient or a third party, except where the processing is ordered by law;
b) the use or transmission of personal data is carried out for direct marketing, public opinion research or scientific research purposes;
c) in other cases specified by law.
The Service Provider shall examine the objection within the shortest possible time from the submission of the request, but no later than within 15 days, decide on the merits, and inform the applicant in writing of its decision. If the Service Provider finds the objection well-founded, it shall terminate the data processing - including further data collection and data transmission - and lock the data, and shall inform all those to whom the personal data affected by the objection has been previously transmitted, and who are obliged to take measures to enforce the objection right.

If the user does not agree with the decision made by the Service Provider, they may, within 30 days of its communication, turn to the court. The court shall act out of turn.
